Parliamentary Debate Declining, Cause of Worry: Chief Justice of India

Chief Justice of India NV Ramana expressed worry about the lack of debate in Parliament and state legislatures, calling it a “sad state of affairs” since the lack of meaningful debate leaves many elements of legislation unclear and puts the load on courts. He claims that extensive discussion throughout the legislative process decreases litigation because, when judges interpret laws, “we all understood the legislature’s objective.”

The Chief Justice urged members of the legal fraternity to participate in public life and share their experience with laws while speaking at the Supreme Court Bar Association’s 75th Independence Day celebration on the top court’s grounds. He said that attorneys were at the forefront of the country’s protracted battle for independence.

“Regrettably, we are aware of what is now taking place in Parliament in terms of legislative debates “In his address to the bar members, CJI Ramana stated. He said that there were debates in Parliament about different constitutional modifications and how they would affect the public in the past.

“It’s a sad state of affairs right now. Due to a lack of discussions, the law-making process is riddled with holes and uncertainty. We don’t know what the legislature’s goal is. We don’t know why laws are enacted in the first place. The people are greatly inconvenienced as a result of this. When members of the legal profession are absent from the Parliament and state legislatures, this occurs.”

Following days of ongoing protests by the Opposition over the Pegasus spying row, agricultural legislation, price rises, and other concerns, the Monsoon session of Parliament was adjourned last week. The Chief Justice advised the attorneys, “Don’t limit yourself to making money and living well in your job. Please consider it. We should take an active role in public life, perform good deeds, and share our knowledge with the rest of the country. Hopefully, good will emerge in the country as a result of it.”

The CJI went on to say that the Supreme Court has played an active role in the country and has contributed more than the Constitution allows, but he wants the legal community to do more. “All lawyers should get involved in the legal aid movement.
