Supreme Court Slams Centre Over Tribunals Act

The Supreme Court voiced its unhappiness with the Union government’s implementation of the Tribunals Reforms Act on Monday, calling it “a near copy of the clauses knocked down by the court.” The panel, which included Chief Justice NV Ramana, justices DY Chandrachud and L Nagendra Rao, also chastised the Centre for failing to fill vacancies in the tribunals.

The Supreme Court adjourned the case until Monday, saying it anticipated appointments to be completed by then. “This court’s decisions are not respected. You’re putting our patience to the test. How many people were chosen? You mentioned that certain people were appointed. What happened to the appointments?”

The operation of tribunals such as the NCLT and NCLAT has been hampered, according to Justice Chandrachud, due to a lack of appropriate members. claiming that the court was “We have just three alternatives,” the CJI stated, “very disturbed” by the circumstances. We’re going to put a hold on the legislation for now. Two, we abolish the tribunals and delegate authority to the Supreme Court. Three, we schedule our appointments.”

According to Justice Chandrachud, the Tribunals Act is “essentially a carbon copy” of the clauses knocked down by the court in the Madras Bar Association case. He went on to say that while the legislature cannot take away a decision’s basis, it also cannot pass a judgment that is contradictory to one.

The court also issued a notice on a writ suit challenging the Act filed by Congress MP Jairam Ramesh. According to the article, Solicitor General Tushar Mehta requested two to three days to respond to the court on the subject.
