The Supreme Court has granted permission for an accused in a drug case who has indicated a desire to give a kidney to his ill father to be transported to the hospital from jail for essential medical testing as needed. Suppose the offender is deemed fit to donate a kidney and the committee of the government medical college involved approves the surgery. In that case, he may seek temporary release before the Madhya Pradesh High Court, which will be “examined compassionately,” according to the court.

This was said by a panel of Justices Indira Banerjee and J K Maheshwari while hearing a petition filed by the individual contesting the Madhya Pradesh High Court’s June judgement dismissing his bail application in the case. The petitioner’s lawyer informed the Supreme Court that his father has renal failure and needs a transplant. He informed the court that the petitioner desires to give a kidney to his sick father.
The state’s attorney had objected to the appeal for bail on numerous grounds, including the gravity of the crime and the petitioner’s other siblings and sisters who could care for their father. According to the medical records, the petitioner’s father requires kidney transplant surgery to improve his survival and quality of life. The bench also ordered the trial court to accelerate the case’s trial and dispose of it as soon as possible, ideally within six months.

The high court observed in its decision denying the accused’s bail plea that he has been in custody since September last year in connection with a case filed under the provisions of the Narcotic Drugs and Psychotropic Substances Act, 1985 for the alleged offence.
