In a significant judgment on Wednesday, the Supreme Court enabled women to pass the examination planned for 5 September. The Apex Court deemed gender discrimination the “political choice” of the Army. The court so permitted women to sit the NDA examination slated to take place on 5 September. The Court of Apex states that admissions govern the ultimate orders of the court.

Kush Kalra filed a written plea requesting women’s permission to attend the NDA entry test. The request highlighted the violation issue by refusing the chance for eligible women candidates to join the NDA of Articles 14, 15, 16, and 19 of the Indian Constitution.

“Female applicants who are qualified and willing are not permitted to sit the NDA and Naval Academy examinations just because of their gender. The respondents’ act of discrimination is a betrayal of the Constitutional ideals of equality (Article 14); equality of opportunity in areas of public employment (Article 16); freedom to practise a profession (Article 19); and non-discrimination (Article 15) “.

Senior Advocate Chinmoy Pradip Sharma and Advocates Mohit Paul, Sunaina Phul, and Irfan Hasieb represented the petitioner. “Women are being given an equal chance in the armed services in the channels that have been opened up for women’s employment,” the Centre stated during the hearing. There is no infringement of any fundamental right just because men and women can join the armed forces in different ways.”

A petition submitted by Kailas Udhavrao More asking girls to be accepted into the century-old Rashtriya Indian Military College in Dehradun in current academic year is being considered in addition to the plea made by Kalra. The Defense Ministry runs this college just for guys.
