New Delhi: A Supreme Court bench comprising Justices Hemant Gupta and Sudhanshu Dhulia on Thursday delivered a split verdict on wearing Hijab in educational institutions. The bench heard a bunch of petitions challenging the Karnataka government’s February 5 order that prohibited wearing of hijab inside classrooms in pre-university colleges. When a few petitioners challenged the government’s order in the Karnataka High Court, it upheld the ban on wearing hijab in educational institutions.

While Justice Gupta dismissed the appeals against the Karnataka High Court order upholding ban on wearing hijab, Justice Dhulia set aside the HC verdict. Justice Dhulia said that he had a different view and allowed the plea against the Karnataka HC order. He said, “It (wearing hijab) is ultimately a matter of choice, nothing more, nothing less.” Justice Dhulia further said that venturing into essential religious practice was not needed and the HC took the wrong way and that education of girl children is of utmost importance for him.

Justice Dhulia said, “A girl child in areas does household work and chores before going to school and are we making her life any better by imposing an additional restriction on her?” Justice Dhulia said he had set aside the Karnataka High Court order and quashed the Karnataka government’s order issued on February 5 this year and issued directions to remove the restrictions. Justice Gupta said in view of divergent opinion, let the matter be placed before the Chief Justice of India for an appropriate order.
