New Delhi: The Supreme Court on Friday set aside the order of the Calcutta High Court refusing to take on record the West Bengal government’s affidavit in the Narada sting case.
The top court allowed the state government, Chief Minister Mamata Banerjee and Law Minister Malay Ghatak to file an application in the high court citing the reasons for not filing the relevant affidavit in time.
A vacation division bench of Justice Vineet Saran and Justice Dinesh Maheshwari has directed all of them to file their applications by June 28. He set aside the June 9 order of the High Court, so that the filing of the applications could be ensured.
The Supreme Court has also directed the petitioners to provide copies of their applications to the CBI by June 27. The division bench also advised the high court to consider June 29 as the date fixed for hearing the application for admission of affidavits.
Ms. Banerjee and Mr. Ghatak have approached the apex court against the order of the Calcutta High Court on June 9. The High Court had on June 9 refused to take his affidavit on record during the hearing of the Central Bureau of Investigation (CBI)’s plea to transfer the Narada string tape case.
The matter was listed for hearing on June 22 before a bench of Justice Hemant Gupta and Justice Aniruddha Bose, but Justice Bose recused himself from the hearing. After that the existing bench was constituted to hear the matter. The new bench had fixed the matter for hearing today.
