New Delhi: The International Commission of Jurists (ICJ) has expressed concern over the Supreme Court’s decision in contempt case to senior advocate Prashant Bhushan in which senior advocate Prashant Bhushan was convicted in the criminal contempt case. The ICJ has appealed to the court to reconsider its decision in the criminal contempt case. Referring to the judgment given by the Supreme Court on 14 August and 31 August, the commission considered it not only inconsistent with international standards but also considered the use of this right as risky by the court.
On these concerns, the commission said that the decision to convict the prominent human rights advocate for two tweets would have an impact on freedom of expression in India. Let me tell you that on June 29, Prashant Bhushan tweeted two on his Twitter handle. In it, he commented by tweeting a picture of Chief Justice Bobde sitting on an expensive bike. In the second tweet, he expressed his opinion on the role of the last four Chief Justices in the context of the situation in India.
On August 31 in the case, a bench headed by Justice BR Gavai and Justice Krishna Murari, headed by Justice Arun Mishra, said that the court took cognizance of the matter after Bhushan made his statement public. The court did not accept Bhushan’s move in the judgment as correct. On the conviction in the Prashant Bhushan case, the ICJ said that conviction is inconsistent with international law on freedom of expression.
