On 10 August 2021, the Mumbai police opposed the pail petitions of businessman Raj Kundra and co-accused Ryan Thorpe, claiming that “if released, they could commit similar offences again and impact the “social culture”. The submission was made before a submission court that that was addressing the bail pleas.
Both the accused have been under judicial custody for their alleged involvement in the production and distribution of pornographic content.
In his bail petition, Raj Kundra had argued that there is no material to prove his involvement in the case, and there is no obscenity in the evidence allegedly seized by the police. The Mumbai Police has, however, alleged that the videos seized during probe contain pornographic material. This content was allegedly uploaded on the “Hotshots” app, which is linked to Raj Kundra’s company, “Armspine”.

Raj Kundra, on the other hand, has maintained that the evidence is of a documentary nature and therefor his extended custody is not justified. He also claimed that he is a family man with deep roots in society, therefore is willing to cooperate in the investigation.
Raj Kundra’s involvement was thoroughly investigated during police custody, and since he faces a maximum punishment of seven years based on the charges invoked, he should be considered for bail, the petition read.
The police’s opposition to the bail was based on the grounds that Raj Kundra an influential person and a British citizen, and therefore could flee the country if released. Also, the victims are women from poor financial backgrounds, and therefore releasing the accused may impact the probe as there are possibilities of apprehension of danger to the lives of those linked to the case, the Mumbai police claimed.
