New Delhi: The Supreme Court on Tuesday rejected the plea of the Uddhav Thackeray-led Shiv Sena faction’s claim to restrain the Election Commission from deciding Shinde group’s plea on recognising it as the real Shiv Sena.

The Shinde faction pleaded that it should be allotted the bow and arrow symbol of the Shiv Sena. A constitution bench headed by Justice D Y Chandrachud rejected the plea of Thackeray-led faction. The apex court directed the EC should go ahead with the proceedings and the court would not put a stay on it. Other members of the bench were Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha.

The SC order asking the EC to go ahead with the proceedings being considered as a defeat to Uddhav Thackeray who was the former chief minister of Maharashtra. He was heading a government comprising the Congress, the Nationalist Congress Party and the Shiv Sena. Eknath Shinde, who was a minister in the Thackery-led cabinet made a flight to the Bharatiya Janata Party (BJP) camp with more than 40 legislators of the Shiv Sena and became the chief minister after big political drama in the state.

Just two days ago, the Maharashtra High Court allowed Thackeray faction of the Shiv Sena to hold Dussehra festival at Shivaji Park in Mumbai on October 5.
