New Delhi: The Supreme Court has deplored the tendency to make allegations against judicial officers when adverse orders are issued against a litigant. The apex court said it would demoralise the judges. The court which dismissed the plea seeking transfer of proceedings pending before a court in Rajasthan’s Dhaulpur to a court in Noida in Uttar Pradesh, made the statement.
A bench comprising Justices M R Shah and Krishna Murari noted that one of the grounds on which the proceedings are sought to be transferred is that the petitioners believe they are not getting a fair trial, and respondents being “local bigwigs” may influence the trial. An aggrieved party may always challenge the order before a higher forum. The court said, “Nowadays, there is tendency to make such allegations against the judicial officers whenever the orders passed against a litigant and the orders are not liked by the litigant concerned. We deprecate such practice.” The court made the above observations on September 2.
