Supreme Court surprised how Vikas Dubey remained out of jail even after several cases were filed

New Delhi: The Supreme Court today heard petitions seeking investigation from the CBI, NIA or SIT on the Vikas Dubey encounter. During the hearing, when the Chief Judge of the Supreme Court came to know that many FIRs were lodged against Vikas Dubey, yet he was surprised when he was out of jail on parole. They called it a failure of the government system.

A bench headed by Chief Justice SA Bobde, while hearing a petition seeking the court’s monitoring of the encounters of Dubey and his alleged aides, told the Uttar Pradesh government that they would have to maintain “rule of law”. The apex court said, “You as a state uphold the rule of law. It is your duty to do so. “

Solicitor General Tushar Mehta, appearing for Uttar Pradesh, sought some time to seek directions from the court and come back on the issue.

“A person like Vikas Dubey got bail despite so many cases,” the bench said. It is the failure of the institution that the person, who should have been behind bars, got bail. “

The CJI told the UP government that as the state government they are responsible for maintaining law and order and there should have been a trial for this. The CJI said that the court wants to add a retired Supreme Court judge and a retired police officer to the committee formed by the government. Regarding this, the court asked the UP government whether it was ready to appoint a judicial commission headed by a retired Supreme Court judge?

The Supreme Court said that it will consist of retired Allahabad High Court judges appointed by UP. The Supreme Court says that the investigation panel should also have a retired police officer. The CJI said that with this investigation, the rule of law will be strengthened and the morale of the police will not be broken.

Eight policemen, including DSP Devendra Mishra, were ambushed in Bikaru village of Chaubepur area of Kanpur when they were going to arrest Dubey.
