New Delhi: The Supreme Court has ordered to prepare guidelines for giving compensation to the Covid victims. The SC said that it is statutorily mandated for the National Disaster Management Authority to provide minimum standards of relief including ex-gratia to the Covid victims. NDMA has failed to discharge its statutory duty by not providing the ex-gratia amount. The court has ordered the Center to prepare guidelines for compensation to the families of COVID victims. The Supreme Court said that the National Disaster Management Authority will decide how much amount to be given to the victims. Guidelines will be prepared in 6 weeks.
Let us tell you that the Supreme Court has refused the order of giving compensation of four lakh rupees on the death due to Covid. The Supreme Court said that it is not proper for the court to order the government to pay a certain amount of compensation. The Supreme Court said that it cannot be denied that if a compensation of Rs 4 lakh is given, then it may cause financial trouble to the government. It is up to the authority to decide the compensation for this.
The Supreme Court said that the NDMA will prepare the guidelines within six weeks. On the death certificates of Covid victims, the Supreme Court said that the death certificate will contain the cause of death. There should also be a mechanism to fix the cause of death if the family is not satisfied.
The Supreme Court said that giving ex-gratia assistance to the families of a person who died from Covid is part of the ‘minimum standards of relief’ prescribed under Section 12 of the Disaster Management Act. Also said that we are not fixing compensation, but NDMA six Issue guidelines to determine the ex-gratia amount to be paid to each Kovid victim within a week. About 3.9 lakh deaths have occurred due to the Kovid epidemic in India, which has been declared a disaster under the Disaster Management Act.
The Supreme Court had reserved the decision on the petition for compensation of Rs 4 lakh.
