Azam Khan has to wait longer for release; HC reserves order after hearing

Lucknow: Allahabad High Court has reserved its order on the bail application of senior Samajwadi Party leader and SP MLA from Rampur Mohammad Azam Khan after a long hearing. The court will give its verdict in this matter in the next week. The Single Bench of Justice Rahul Chaturvedi has reserved its decision after hearing the arguments of both sides after a long debate that lasted for about two and a half hours. It is clear that Azam Khan has not got any relief from the High Court today, so he will still have to remain in jail.

Significantly, a total of 87 criminal cases are registered against Mohammad Azam Khan. Out of which Azam Khan has got bail in 86 cases. The last case against him pertains to enemy property. The hearing of this case was going on in the Allahabad High Court. Earlier, on December 4, 2021, the High Court had reserved the judgment after the completion of the arguments in this case, but after the decision in this matter for about 4 months, the Yogi government of UP filed the application and supplementary in the High Court. The government demanded from the court that some new facts have come to the fore in this case which it wants to present in the court. After accepting the application of the state government, the court started hearing again in this matter. Whereas after the hearing which lasted till May 4 and May 5 (two days), the court has reserved its decision. Azam Khan's lawyer has said that the state government could not present some new facts in the court, but the same cases were raised again in the court which was already included in the charge sheet.

In the hearing that lasted for two days in the Single Bench of Justice Rahul Chaturvedi, the lawyers of Azam Khan called the case filed against him wrong and said that all the cases have been filed politically motivated and so far he has got bail in 86 cases. While the state advocates opposed the bail application saying that the land of enemy property should be included in the trust on the basis of forged documents. However, Azam Khan's lawyers told the court that in the year 2014, the land was given to the BSF and a case had taken place in this case. There is a stay in the court in this matter. In 2015, the Shia Waqf Board also claimed this land. In this case also there is a stay from the High Court. While the state government is calling the government a custodian, calling it an enemy property.

According to Azam Khan's lawyer Kamrul Hasan Siddiqui, if Azam Khan gets bail in this last case related to enemy property, then the way for him to come out of jail will be cleared. In August 2019, a case was registered against the SP MLA in the Azim Nagar police station of Rampur in this case related to enemy property. After the investigation in this case, the charge sheet has also been filed.

Politics over Azam's release

 Recently, the media advisor to SP MLA Fasahat Ali had made serious allegations against Akhilesh Yadav and said that the SP chief does not want Azam Khan to come out of jail. Not only this, after this many supporters of Rampur MLA had resigned from the Samajwadi Party. After this, PSP Chief Shivpal Singh Yadav also accused Akhilesh Yadav and Mulayam Singh Yadav that if both the leaders stood with Azam Khan, he would have been out of jail. With this he met Azam in Sitapur Jail and said that I always stand with him. With this, he said that when he comes out of jail, then we will decide about forming a new front in UP.
