Nirbhaya case: Supreme Court said, Vinay is mentally healthy, dismiss petition

New Delhi: The Supreme Court on Friday rejected the plea of ​​Nirbhaya gang rape and murder convict Vinay Kumar Sharma. In the plea, the convict challenged President Ram Nath Kovind’s dismissal of the mercy petition. After the verdict of the apex court, the way of hanging Vinay has been cleared. The Supreme Court in its order also said that the medical report states that Vinay is mentally sound and his medical condition is stable.

Earlier on Thursday, a bench of Justice R Bhanumathi, Justice Ashok Bhushan and Justice AS Bopanna said after hearing the petition of Vinay Sharma for nearly 2 hours that the order would be pronounced at 2 pm on Friday.

Vinay Sharma, one of the four death row convicts in the Nirbhaya gangrape case, had filed a writ petition before the Supreme Court challenging the President’s rejection of his mercy petition. On 1 February, President Ram Nath Kovind dismissed Vinay Sharma’s mercy petition in the case. The mercy plea of ​​convicts Akshay Thakur and Mukesh Singh has also been dismissed.

Justice R Bhanumathi fainted while hearing the Central Government’s plea for separate execution of Nirbhaya convicts. He was then hurriedly moved to his chamber, adjourning the hearing. It has been said that a decision in the case will be issued later. Regarding the deterioration of Justice Bhanumathi, Solicitor General Tushar Mehta told that, Justice R.K. However, he is now conscious and under the supervision of doctors.

Vinay had argued in his plea that he became mentally unwell due to ‘alleged torture and abuse’ in jail. Sharma’s lawyer AP Singh said that the President had maliciously rejected his client’s mercy petition as all the records related to the case were not kept before him.
