Rajasthan Speaker to move SC after HC grants relief to Pilot camp

Jaipur: Now the Speaker of the Assembly will go to the Supreme Court against the immediate relief received from the High Court on the notice petition to the Sachin Pilot camp in Rajasthan. Speaker Dr. CP Joshi said at a press conference in Jaipur on Wednesday that he will go to the Supreme Court to stay the current process in the High Court. Speaker Dr. CP Joshi said that there is no conflict between the two Constitutional authorities, so they have decided to file SLP in the Supreme Court.

Dr. Joshi told the media that I have come to draw attention to an important topic for parliamentary democracy. In the parliamentary system, everyone’s role is defined. In 1992, the Supreme Court gave instructions to stop Aya Ram Gaya Ram culture, in which the speaker has been given the right to disqualify under defection. No one has the right to interfere in the midst of this process. In 1992, the constitutional bench of the Supreme Court made it clear that the speaker has the right to be disqualified under the defection law. There can be no intervention before a decision is made, but before the decision on this stage, our colleagues want to challenge.

Dr. Joshi said that interfering at this stage is a threat to parliamentary democracy. The role of the speaker is clear. I respect whatever judgment the court has given, but this does not mean that the encroachment is allowed. The Speaker has the right to hear an application under the rules of the Legislative Assembly. He said that only after the decision of the speaker can he be challenged.

Dr. Joshi said that he respected the court, but our colleagues do not want to come to the speaker to answer the notice, they went straight to the court, this is a danger. The court has not yet intervened in the midst of the Speaker’s notice. The speaker has the right to issue a show cause notice on the complaint of disqualification under the defection law. Joshi said that there is not a single Judgment when there is interference in between. Confrontation situations can occur. That is why we have decided to go to the Supreme Court. I hope the Supreme Court will hear it soon.
