Lucknow: The Allahabad High Court has ordered the immediate release of Dr. Kafeel Khan. The court termed unlawful detention of Dr. Kafeel and extension of custody under NSA. A bench of Chief Justice Govind Mathur and Justice Soumitra Dayal Singh passed the order on a petition filed by Dr Kafeel’s mother Nuzhat Parveen. Dr. Kafeel Khan was detained following a speech against the Citizenship Amendment Act (CAA) under the National Security Act (Rasuka).

Dr Kafeel Khan reportedly gave a speech at the Aligarh Muslim University on 13 December during the CAA protest. The speech was imposed on him by the Uttar Pradesh government as a provocation.

Dr. Kafeel was arrested at Mumbai Airport on January 29 in a case registered with the Civil Lines Police Station in Aligarh. On February 10 this year, the Aligarh CJM court ordered bail, but before his release, NSA was imposed on him. In such a situation, he could not come out of jail.

The court, while ordering his release, said, “After reading the entire speech it does not seem at first sight that he tried to incite any kind of violence.” It seems that the District Magistrate ignored some of the selections and sayings bypassing the real purpose of his speech.
